An Ogun State High Court has struck out a case on a dispute over the Iyalode Efunroye Tinubu Family Estate.
Justice O. Mabekoje ruled on an application to discontinue it by the applicants’ counsel Mr J.O.Ogunbiyi.
He relied on a supporting affidavit sworn to by Gafar Ibrahim, who stated that the families had closed ranks.
It followed the affirmation of Adamakin Investment and Works Limited and Chief Akinfolabi Akindele as having the power of attorney over the estate.
Before the case came up, some elders of the Shobowale and Lumosa families met to settle the dispute out of court.
The family, which consists of two branches – Shobowale and Lumosa – agreed that a board of trustees should be constituted to administer the affairs of the estate.
It was in a bid to recover a part of the estate, covering 16 local government areas in Lagos, which had been encroached upon by strangers and to harmonise the interest of the entire family and ward off impostors.
The heads of the two family branches and two accredited representative approached the court for the appointment of the trustees.
Last April 29, the court made an order appointing the second, third and fourth claimants as well as the late Chief Adams Lahan as the fourth trustees to the Estate of Late Iyalode Efunroye Tinubu.
The second and fourth claimants belong to the Lumosa branch of the family; the third claimant and the late Chief Lahan are of the Shobowale family.
Due to their inability to handle the complexities involved in the running of affairs of the entire estate, the trustees donated a power of attorney to Adamakin Investment and Works and Chief Akindele in August 2012 to act on their behalf.
The suit arose when some members of the board of trustees of the estate went to court in 2019 to challenge the legal status of Adamakin Investment and Works and Chief Akindele as the sole holders of the power of attorney.
