A fresh hearing into the legal battle over the Kano Emirate tussle involving Alhaji Ado Bayero and Muhammadu Sanusi has been ordered by the Appeal Court in Abuja.
Delivering judgment on Friday, the court held that Sanusi was denied a fair hearing due to the shoddy manner in which a Kano High Court conducted proceedings against him.
While delivering the lead judgment, Justice Mohammed Mustapha said the Kano High Court was unfair to Sanusi as it conducted proceedings without serving him a hearing notice to enable him to present his case.
Mustapha stated that all courts of law are bound to ensure justice for all parties by giving them equal opportunities.
He called the conduct of the proceedings against Sanusi a travesty of justice.
The Appellate Court further held that Sanusi should have been served with a notice to air his grievances before judgment was delivered against him, describing it as a shoddy arrangement.
It subsequently ordered that the case be remitted to the Chief Judge of the Kano State High Court to be reassigned to another judge for expeditious determination.
